The general terms and conditions (AGB) governing purchases from Wet My Plants.
Scope
These T&Cs apply to all orders placed by consumers through the Wet My Plants online shop with a delivery address in Switzerland and the Principality of Liechtenstein. Differing terms of the customer apply only with our express written consent.
Contract formation
The presentation of products in the shop does not constitute a binding offer. By submitting your order you make a binding offer; the contract is formed upon our order confirmation by email or, at the latest, upon dispatch of the goods.
Prices & payment
All prices are in Swiss francs (CHF) including statutory value-added tax (VAT). Accepted payment methods are credit and debit card as well as TWINT. The purchase price is due for payment upon conclusion of the contract.
Statutory warranty
Products purchased from Wet My Plants carry the statutory two-year warranty for defects under Swiss law (Code of Obligations, OR Art. 210).
The statutory warranty rights under CO Art. 197 et seq. apply; the limitation period is two years from delivery (CO Art. 210). Obvious defects must be reported to us within a reasonable period after discovery. Any manufacturer warranty exists in addition and does not limit your statutory rights.
Returns
We offer a voluntary 30-day return window from the date of delivery — see Shipping & Returns for the full policy. This is offered as a trust commitment; it is not a requirement of Swiss law.
The voluntary 30-day return right applies in addition to your statutory warranty rights and is consistent with the Shipping & Returns page. Excluded are used or damaged goods and items not returned in resaleable condition.
Liability
We are liable without limitation for intent and gross negligence. For slight negligence we are liable only for the breach of material contractual obligations and limited to the foreseeable damage typical for such contracts. Mandatory liability, in particular under the Product Liability Act (PrHG), remains unaffected.
Governing law & jurisdiction
These terms are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction is, to the extent legally permissible, the registered seat of Wet My Plants GmbH in Zürich. Mandatory consumer-protection provisions at the domicile of consumers in the EU/EEA remain reserved.
